1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the WellnessIQ mobile application and website (collectively, the "Service") operated by WellnessIQ ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.
If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
WellnessIQ provides Claude AI-powered fitness coaching, personalized workout plans, and fitness guidance for users interested in achieving specific health goals. Our Service uses artificial intelligence to generate coaching content tailored to your selected fitness goals and experience level.
⚠️ Important: WellnessIQ is an educational and training supplement — not a replacement for qualified healthcare professionals, fitness experts, or medical advice. Always consult appropriate professionals before beginning any new exercise program or making significant changes to your health routine.
3. Eligibility
To use WellnessIQ, you must:
- Be at least 13 years of age
- If between 13 and 18, have parental or guardian consent
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from receiving services under applicable law
4. Account Registration
To access WellnessIQ, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
You may not create accounts using automated means or create multiple accounts to circumvent subscription limitations or free trial policies.
5. Subscriptions and Billing
Free Trial: New users may access a limited free trial of WellnessIQ. The trial includes a capped number of AI coaching interactions and workout plan generations. Trial limitations are enforced automatically.
Paid Subscriptions: After your free trial, continued access requires a paid subscription at the rates displayed in the app at time of purchase.
- Basic Plan: $11.99/month
- Premium Plan: $19.99/month
Billing: Subscriptions are billed through Apple App Store or Google Play Store. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial subscription periods except where required by applicable law.
Price Changes: We reserve the right to modify subscription pricing with reasonable advance notice. Continued use after price changes take effect constitutes acceptance of the new pricing.
6. Acceptable Use
You agree to use WellnessIQ only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to bypass, disable, or circumvent any security features or usage limits
- Share your account credentials with others or allow others to use your subscription
- Use the Service to generate content that is harmful, offensive, or inappropriate
- Attempt to reverse engineer, decompile, or extract source code from the app
- Use automated systems, bots, or scripts to access or interact with the Service
- Impersonate any person or entity or misrepresent your affiliation
- Introduce malware, viruses, or other malicious code
- Engage in any activity that could damage, disable, or impair the Service
7. AI-Generated Content
WellnessIQ uses artificial intelligence to generate coaching content, workout plans, and responses. You acknowledge that:
- AI-generated content is for informational and educational purposes only
- AI coaching does not constitute professional medical, healthcare, or fitness advice
- Results may vary and are not guaranteed
- You should consult qualified healthcare professionals before beginning any exercise program, especially if you have existing health conditions or injuries
- We are not liable for health or fitness outcomes that may result from following AI-generated recommendations
8. Intellectual Property
The WellnessIQ application, including its design, features, branding, and underlying technology, is owned by WellnessIQ and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.
Content you submit through the coaching chat remains yours. By submitting content, you grant us a limited license to use that content solely for the purpose of providing and improving the Service.
9. Health and Safety Disclaimer
Physical activity and fitness training involve inherent risks. By using WellnessIQ's workout and training features, you acknowledge:
- You are voluntarily participating in fitness and training activities
- You should obtain medical clearance before beginning any new exercise program
- WellnessIQ is not responsible for health issues or injuries sustained while following our coaching recommendations
- You should listen to your body and stop any activity that causes pain or discomfort
- AI-generated workout plans should be adapted based on your individual physical condition and health status
10. Limitation of Liability
To the maximum extent permitted by applicable law, WellnessIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.
12. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by cancelling your subscription and deleting the app, or by contacting us at support@wellnessiq-app.info.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New Mexico.
14. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
